Terms of Service

The websites https://www.collectorshelpingcollectors.com and related mobile or store apps (together, the “Service”) are operated by Mal's Magic Emporium, LLC(“Mal's Magic Emporium,” “we,” “us,” or “our”).

Collectors Helping Collectors is a product of Mal's Magic Emporium, LLC. The related retail store at malsmagic.com is a separate shopping site. A store purchase does not include a Pro subscription here, and Pro does not include store merchandise unless we say so in writing.

Agreement

By creating an account, scanning an item, starting a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old. If you are under 18, you may use the Service only with a parent or guardian’s permission. The Service is not directed to children under 13.

What the Service is

Collectors Helping Collectors lets you photograph a collectible, request an automated identification and estimated market context, save items to a catalogue, and optionally subscribe to Pro for higher limits and paid features described on the Upgrade page.

The Service is a hobby and research tool. It is not a licensed appraisal, a guarantee of sale price, authenticity, or condition, an insurance valuation, or legal, tax, or investment advice. Identifications and values can be wrong. You are responsible for your own buying, selling, and collecting decisions.

Accounts

You must provide accurate account information and keep it current. You are responsible for activity under your account. Tell us promptly at MalsMagicEmporium@gmail.com if you think someone else is using it. We may refuse, suspend, or close an account if we believe these Terms were broken, the Service is being abused, or we are required to by law.

Free use and Pro subscriptions

We may offer a limited free tier. Free limits, Pro features, and prices are shown in the Service and may change. Paid plans are subscriptions billed through Stripe. The live price is the price shown at checkout when you subscribe.

• Billing is handled by Stripe. We do not store full card numbers.
• Unless the law requires otherwise, fees are charged in advance and are non-refundable except as required by Stripe, card-network rules, or law.
• You can cancel through the Customer Portal, or by emailing us if the Portal is unavailable. Cancellation stops future renewals. You keep Pro until the end of the period you already paid for.
• We may change the price with notice before the next renewal.
• Taxes may apply. Chargebacks may result in immediate loss of Pro access.

Your content and photos

You keep ownership of photos and notes you upload. You grant us a limited license to host, process, crop, compress, transmit, and display that content so we can run the Service for you, including sending an image to a vision provider and showing a thumbnail in your catalogue.

Do not upload content you do not have the right to use. Do not photograph people without permission when a person is the main subject. Do not upload illegal material or content that infringes someone else’s rights. We may remove content that we believe violates these Terms.

Acceptable use

You agree not to scrape, overload, or reverse engineer the Service; resell raw identification output as a competing automated service; bypass free-scan limits or paywalls; use the Service to commit fraud or deceptive sales; upload malware; or access other users’ accounts. We may rate-limit or block traffic that harms the Service or our providers.

Third-party services

The Service depends on companies we do not control, including Stripe, Anthropic and similar AI providers, Vercel or other hosts, authentication and database providers, and public marketplace information used as context for estimates. If a provider fails, identification, login, catalogue sync, or billing may fail.

Intellectual property

The Service name, logos, layout, and our software belong to Mal's Magic Emporium, LLC or its licensors. You may not copy the product or use our marks to suggest we endorse your listings or shop without written permission.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY IDAHO LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that identifications are correct, that values match what you can sell an item for, or that the Service will be uninterrupted.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAL'S MAGIC EMPORIUM, LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM OR (B) TWENTY-FIVE U.S. DOLLARS ($25).

Indemnity

You will defend and indemnify Mal's Magic Emporium, LLC against claims that arise from your content, your use of the Service, your listings or sales, or your violation of these Terms or the law.

Termination

You may stop using the Service at any time and cancel a subscription as described above. We may suspend or end the Service or your account if we believe there is abuse, legal risk, non-payment, or harm to other users or providers. After termination we may delete or anonymize your catalogue according to the Privacy Policy, except where we must keep records.

App stores

If you download an iOS or Android application, Apple or Google are not a party to these Terms and are not responsible for the app. Their store terms also apply.

Changes

We may update these Terms by posting a new version on the Service. Continued use after the change means you accept the new Terms. For material changes to paid plans we will try to give notice before the next charge.

Governing law

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Disputes are construed under the laws applicable in Kootenai County, Idaho. You and we agree to the exclusive jurisdiction of the state or federal courts sitting in Kootenai County, Idaho, except that we may seek injunctive relief anywhere.
